This policy explains how Carlei Estate Wines ("Carlei", "we", "us") collects, uses, stores and discloses your personal information.

We are bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy applies to our websites, to our cellar door, and to our events.

2. What we collect

We only collect what we need. Depending on how you deal with us, that may include:

When you join our list at an event or through a form

  • your first name
  • your mobile number
  • your email address
  • which wine you preferred, where you tell us
  • the date you gave us permission to contact you, and the exact wording you agreed to

When you visit the cellar door or buy from us

  • your name and contact details
  • your order and payment details, which are handled by our payment provider and not stored by us
  • any delivery address you give us

When you use our websites

  • standard technical information such as your IP address, browser type, the pages you viewed and the site that referred you
  • information from cookies and similar technologies, described in section 9

Sensitive information. We do not seek sensitive information as defined by the Privacy Act. Please do not send it to us.

Children. Our products are alcohol. Our sites and lists are for people aged 18 and over. We do not knowingly collect information from anyone under 18. If we learn that we have, we will delete it.

3. How we collect it

We collect personal information directly from you: when you fill in a form, scan a code at an event, buy something, book a tasting, email or phone us, or subscribe to our newsletter. We may also collect it from our booking and point of sale systems when you make a reservation or a purchase.

We do not buy contact lists, and we do not add people to our marketing list without their permission.

4. Why we use it

  • to send you wine news, offers and event invitations, where you have agreed to receive them
  • to fulfil and deliver your orders, and handle returns
  • to manage bookings and tastings
  • to answer your questions
  • to tell you about something that affects an order you have placed
  • to understand which wines and events our customers respond to, so we make better ones
  • to meet our obligations under liquor licensing, tax and consumer law

Marketing and your consent. We send marketing messages only to people who have opted in. We comply with the Spam Act 2003 (Cth). Every marketing email we send carries a working unsubscribe link, and we act on unsubscribe requests promptly. We record the date you consented and the exact wording you agreed to.

We do not sell your personal information. We do not rent or trade it either.

5. Who we share it with

  • Our customer and email platform. We use HighLevel (LeadConnector) to store contact records and send email. Email delivery is handled by Mailgun.
  • Payment providers, to process payments. We do not store your full card details.
  • Delivery and freight partners, where an order needs shipping.
  • Booking and point of sale providers, where you make a reservation or a purchase.
  • Professional advisers, such as our accountants and lawyers, where needed.
  • Government bodies and regulators, where the law requires it.

We require our providers to protect your information and to use it only for the purpose we engaged them for.

6. Overseas disclosure

Some of our providers store and process data outside Australia, including in the United States. That includes our customer and email platform.

By giving us your information, you acknowledge it may be handled overseas, where privacy laws may differ from Australian law. We take reasonable steps to ensure any overseas recipient handles your information consistently with the Australian Privacy Principles.

7. How long we keep it

  • Marketing contacts: until you unsubscribe or ask us to delete you, and then only the minimum record needed to make sure we do not contact you again.
  • Order and transaction records: at least seven years, because tax and liquor licensing law requires it.
  • Enquiries: generally two years after we last dealt with you.

8. How we protect it

We take reasonable steps to protect your information from misuse, loss and unauthorised access, including access controls on our systems, restricting staff access to people who need it, and using reputable providers who encrypt data in transit and at rest.

No system is perfectly secure. If a data breach occurs that is likely to cause you serious harm, we will notify you and the Office of the Australian Information Commissioner as required by the Notifiable Data Breaches scheme.

9. Cookies and tracking

Our websites use cookies and similar technologies to make the site work, remember your preferences, and understand how the site is used. Our email messages may record whether a message was opened and which links were clicked, so we can tell what our customers find useful.

You can block or delete cookies in your browser settings. Some parts of the site may not work properly if you do.

10. Your rights

You can, at any time:

  • Ask what we hold about you. We will respond within a reasonable period, normally 30 days, and we do not charge for this.
  • Ask us to correct it, if it is wrong or out of date.
  • Ask us to delete it, subject to records we are legally required to keep.
  • Unsubscribe from marketing, using the link in any marketing email or by contacting us.
  • Complain, if you think we have mishandled your information.

11. Complaints

Please contact us first at [email protected]. We will acknowledge your complaint promptly and aim to resolve it within 30 days.

12. Changes to this policy

We may update this policy from time to time. The current version is always the one published on our website, with the date at the top. If we make a significant change to how we handle your information, we will tell you.
